Terms of Service Agreement

Please read our terms and conditions below so you are informed of the scope of our service. Your payment for research services indicates your agreement with these terms.
Terms and Conditions of Use
1. Payments
1.1 Since genealogical problems vary widely and some take much more time to solve than others and may even be unsolvable at the present time, payments are not based on results. Legacy Tree Genealogy clients are buying our professional time and we cannot be responsible for the positive or negative results of the research project. We strive for excellence and accuracy in research and can simply guarantee that we will do professional-grade work.
1.2 Once research has begun we cannot refund deposits. If a refund is requested three days after the charge was made and before research has begun a 5% credit card processing fee will be charged.
1.3 Research results cannot be provided until payment has been made in full.
1.4 Payments made by paper check are converted into an electronic fund transfer. This results in no additional fees to the client but may result in faster processing time. By sending a completed, signed check to us, the client authorizes us to use the account information from the check to make an electronic fund transfer from the client's account for the same amount as what is written on the check.
2. Completion Time
2.1 Research can begin only after we have received necessary information from the client. The client is requested to provide a detailed research request to Legacy Tree Genealogy which includes all known information concerning the family or individual to be researched as well as any previous research that has been conducted. Legacy Tree Genealogy is not responsible for duplication or misdirection of effort due to a lack on the client's part to provide all necessary information.
2.2 Research projects are handled in the order in which the deposit, research goals, and genealogical information are received from the client. We strive to return completed projects to our clients within 12-16 weeks. However, since records sometimes have to be ordered from repositories outside of Salt Lake City and we cannot control how soon these records are received, a project may take longer to complete than anticipated. Rush ordering is available but completion time cannot be guaranteed.
3. Tax Deductible Payments
Clients belonging to a religious organization which encourages its members to perform genealogical research may qualify to make payments through our affiliate charitable organization for tax deductible purposes. Any research payments besides those made through our charitable organization are not considered to be tax deductible, and not all persons qualify to make payments through the charitable organization.
4. Rights
Legacy Tree Genealogy has the right at any time and at its sole discretion to modify the terms of this agreement. Modifications will be posted online or communicated with the client via email or post if necessary. Use of our services means that you have accepted and are bound by this agreement's terms. If you are dissatisfied with any portion of our services your sole and exclusive remedy is to discontinue using our services. We likewise reserve the right to refuse service to any potential client at our sole discretion.
This agreement is governed by the law of the State of Utah and the Federal law of the United States of America.
